Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HypnoBirth App mobile application and website at hypnobirthapp.com (together, the "Service"), operated by HypnoBirth App ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have parental or legal guardian consent. By using the Service, you represent that you meet these requirements.

2. Account Registration

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Service

HypnoBirth App provides guided hypnobirthing audio sessions, pregnancy meditations, breathing exercises, birth affirmations, a contraction timer, a baby kick counter, and related pregnancy wellness content. The Service is available free with limited content, and through a premium subscription for access to the full audio library and additional features.

4. Medical Disclaimer

The Service is not medical advice. HypnoBirth App provides relaxation, meditation, and breathing tools for pregnancy wellness and birth preparation. It is not a substitute for professional medical care, diagnosis, or treatment.

Always consult your OB-GYN, midwife, or qualified healthcare provider before making decisions about your pregnancy, labor, or postpartum care. Do not disregard professional medical advice or delay seeking it because of information or content provided through the Service.

Hypnobirthing techniques may support relaxation and coping during labor, but they do not guarantee specific birth outcomes, including pain-free labor, shorter labor duration, or avoidance of medical interventions. Individual results vary.

5. Subscriptions and Payments

Premium features are available through auto-renewing subscriptions purchased via the Apple App Store or Google Play Store. Subscription terms, pricing, and billing cycles are displayed at the time of purchase and are governed by the respective app store's terms.

You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods, except as required by applicable law or app store policies.

Free trial periods, if offered, automatically convert to a paid subscription unless cancelled before the trial expires.

6. Intellectual Property

All content in the Service — including audio recordings, text, graphics, logos, design, and software — is owned by or licensed to HypnoBirth App and is protected by copyright, trademark, and other intellectual property laws.

You may use the Service for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Service without our prior written permission.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Share, redistribute, or resell audio content or other premium materials
• Attempt to reverse-engineer, decompile, or access the source code of the app
• Interfere with or disrupt the Service or its servers
• Impersonate any person or entity
• Use automated tools to scrape, harvest, or collect content from the Service

8. AI Pregnancy Chat

Premium members may access an AI-powered pregnancy chat feature. This feature uses third-party AI technology (currently OpenAI) to generate responses. AI-generated responses are for informational purposes only and are not medical advice. Responses may contain errors or inaccuracies. Do not rely on AI chat for medical decisions — always consult a qualified healthcare provider.

9. Third-Party Links

The Service may contain links to third-party websites, apps, or resources. We are not responsible for the content, accuracy, or practices of third-party sites. Accessing third-party links is at your own risk and subject to their terms and privacy policies.

10. Limitation of Liability

To the maximum extent permitted by law, HypnoBirth App and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages related to pregnancy outcomes, birth experiences, emotional distress, or reliance on content provided through the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $50, whichever is greater.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Indemnification

You agree to indemnify and hold harmless HypnoBirth App, its owners, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including liability limitations, disclaimers, and indemnification) will remain in effect.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
